The off-payroll working rules (commonly known as IR35 or ‘the intermediaries’ legislation’) have been in place for some time, originally introduced in 2000.

IR35 - Your Questions Answered

What is IR35?

The off-payroll working rules, commonly referred to as IR35 or ‘the intermediaries’ legislation’, were introduced in 2000. These rules are designed to ensure that workers who operate through intermediaries—such as Personal Service Companies (PSCs), Partnerships, or other similar entities—pay taxes similar to employees if their working practices resemble those of an employee.

What Has Changed?

From 6th April 2021, the responsibility for determining IR35 status shifted. The contractor no longer decides their own IR35 status. Instead, the end client (the business receiving the contractor’s services) is responsible for assessing whether the off-payroll working rules apply to the assignment.

What Do Clients Need to Do Differently?

Clients are now required to assess whether the off-payroll working rules apply to any contractor engagement before the assignment begins. For incumbent workers, the client must also provide a determination on whether the rules apply to the current assignment.

This determination must be provided in writing, including the rationale behind the decision. It must then be shared with all parties in the supply chain (e.g., the agency, umbrella company, and/or PSC). This written document is called the Status Determination Statement (SDS).

How Does Tax Liability Flow Down the Supply Chain?

Click here to view the attached illustration. This example provides an overview of the supply chain and how liability for taxes passes from one party to another, depending on whether an action is performed—or omitted—as required.

Do the IR35 Reforms Affect Every Organisation?

Do Small Companies Need to Consider the Off-Payroll Rules?

The off-payroll reforms do not apply to small companies as defined by the Companies Act 2006. IR35 is tax legislation introduced in July 2000 to tackle tax avoidance by individuals providing services through intermediaries—such as Personal Service Companies—who may not be paying the appropriate levels of income tax and National Insurance.

From 6th April 2021 onwards, that responsibility shifted to the hirer or end client. Build your career with CBSbutler

Great recruitment careers are built on more than targets.

At CBSbutler, we want ambitious people to build careers they can be proud of.

Whether you’re an experienced recruiter looking for your next challenge, a specialist ready to take greater ownership of your market, or someone looking to build a career in recruitment, we’re interested in people who want to develop, perform and make a genuine impact.

Why CBSbutler?

We’ve spent decades building specialist recruitment teams across some of the most exciting and technically demanding markets.

Our consultants work with organisations and professionals across Engineering, IT, Defence Technology, Defence Consultancy, Aviation & Aerospace and Business Support, giving you the opportunity to develop genuine expertise in your market rather than simply filling vacancies.

But joining CBSbutler isn’t just about the sector you recruit into.

It’s about having the opportunity to build something.

Build your desk. Build relationships. Build your knowledge. Build your reputation. And, importantly, build your career.

What can you expect?

The opportunity to progress

We want people to develop their careers with us.

That could mean becoming a high-performing recruitment specialist, taking ownership of a market, developing key client relationships, moving into leadership or helping us grow into new sectors and locations.

There isn’t one definition of success.

We want to understand where you want your career to go and help you build the skills and experience to get there.

Specialist markets

Recruitment is easier to enjoy when you can become genuinely knowledgeable about the people and businesses you work with.

Our teams recruit across specialist markets including:

Engineering

IT

Defence Technology

Defence Consultancy

Aviation & Aerospace

Business Support

Built Environment and BMS

Medical & Life Sciences

You’ll have the opportunity to understand your market properly, build long-term networks and become someone clients and candidates trust for advice – not simply another recruiter making calls.

Support to perform

Recruitment can be demanding.

That’s why we believe good people need the right environment around them to perform.

You’ll work alongside experienced recruiters, team leaders and directors who understand the realities of the job and can provide support, coaching and guidance when you need it.

We want people to have autonomy and ownership, while knowing that help is available when they need it.

What we're looking for

There isn't one type of person who succeeds at CBSbutler.

You might already have years of recruitment experience.

You might be building a specialist desk and looking for greater opportunity.

Or you might be considering recruitment as the next step in your career.

What matters to us is how you approach it.

We're interested in people who are:

Ambitious
You want to achieve something and are prepared to put the work in to make it happen.

Curious
You want to understand your market, your clients and the people you represent.

Commercial
You understand that recruitment is ultimately about creating value for candidates, clients and the business.

Resilient
Recruitment has brilliant days and difficult ones. You can learn from both.

Good with people
You enjoy building relationships and communicating with different personalities.

Accountable
You take ownership of what you do and follow through on commitments.

And above all, we want people who treat candidates, clients and colleagues properly.

Already working in recruitment?

If you're an experienced recruiter, you probably don't need another recruitment company promising you a "great culture".

You need to know whether you can build a successful career here.

At CBSbutler, we're interested in recruiters who want the opportunity to develop a specialist market, build strong client relationships and have genuine ownership over their desk.

Depending on your experience and ambitions, that could mean joining an established team, helping us develop a growing specialism or building something new.

If you're performing well but feel you've reached the ceiling where you are, we'd be interested in having a conversation.

New to recruitment?

You don't necessarily need recruitment experience to build a successful recruitment career.

Some of the most important skills come from elsewhere: confidence, communication, curiosity, organisation, resilience and the ability to build relationships.

If you have the right attitude and the willingness to learn, recruitment can offer a career where your development and earning potential are closely connected to what you put into it.

We'll help you understand the recruitment process, develop your market knowledge and build the skills you need to become a successful consultant.

Life at CBSbutler

We take what we do seriously, but that doesn't mean everything has to feel corporate.

Recruitment is a people business, and we want CBSbutler to be somewhere people can do good work, develop professionally and enjoy being part of the team.

Your career could go further than you think

A recruitment career doesn't have to follow a fixed path.

At CBSbutler you could develop as a specialist consultant, become a top biller, manage key accounts, build a new market, lead a team or progress into senior management.

What that career looks like will depend on your strengths and ambitions.

Delievery Consultant → Recruitment Consultant → Lead / Senior Consultant → Team Leader → Recruitment Director

Benefits of joining CBSbutler

Competitive package

Commission & incentives

Career progression
Clear opportunities to develop your recruitment career.

Learning & development
Coaching and support to help you continually improve.

Flexible / hybrid working

Holiday
25 days plus bank holidays, with 2 days added after 2 years service

Team incentives & socials

Additional benefits
Pension / healthcare / wellbeing

Find your next opportunity

If you’re looking for a recruitment business where you can develop your expertise, take ownership of your career and have the opportunity to make a genuine impact, we'd like to hear from you.

We're always interested in speaking to talented people.

If you'd like to have a confidential conversation about joining CBSbutler, send us your details and we'll be in touch.

REGISTER YOUR INTEREST

Your next recruitment role could be the start of something much bigger.
